Before you begin using www.photomaxing.co.nz, please read the following Terms and Conditions carefully. We reserve the right to change these Terms without notification. By continuing to access or use www.photomaxing.co.nz, you agree to be bound by any such revised Terms. By entering and using the Service, you accept these Terms and Conditions and agree to be legally bound and subject to them.

Definitions

In these terms of trade, references to "we", "our" or "us" are references to PhotoMaxing Limited and references to "you" and "your" are references to the customer.

Photo Quality WARNING

We provide guidelines for the minimum size of a photo to be used on the website, however we do not monitor or check the quality of an uploaded image. If you upload an image below our minimum recommended size of 500kb a warning will come up saying the photo is below our recomendations. It is the customers responsibility to ensure they are happy with the resolution (clarity) of an image being used. Pictures that fall below our minimum recommended size (500kb) may look OK when viewed online, but could appear blurry and pixilated when enlarged and printed. PhotoMaxing is not responsible for pictures that fail to meet expectations due to their small size.

Photo Quality

www.photomaxing.co.nz is fully automated, we do not check, modify or enhance the image uploaded in anyway. If an image is dark, blurry or fuzzy it will print this way. We produce cards on high quality 265gsm paper using the latest digital printing methods. We do not do photo developing, therefore images will appear different to a camera shop image or printing onto photo quality paper.

The image you view in Step 2 (add a border) is exactly what will be printed.  If you photo has been 'cropped' or moved to be centered within the border it will print this way.  Our 'no frame' cards have 2mm trimmed off the sides when the cards are cut to size.

PhotoMaxing reserves the right to reprint or refund orders relating to photo quality or border colour. Refunds and reprints will be given at the discretion of the Company Management. All cards are individually checked prior to being dispatched and deemed to be best quality in relation to the uploaded image.

As all computer monitors are individually set, the colours of borders are provided as a guide only and may appear different when printed.

Adding text to cards

www.photomaxing.co.nz now provides the ability to add a personal message to your cards. We do not check, modify or correct customer's personal messages on the cards. What is typed and previewed online is exactly what will be printed on your cards. It is the customers' responsibility to ensure all text details are correct. All fonts, sizes and placment of text is pre-programmed into the border you choose, and cannot be modified.

Price and Payment

For all goods ordered, you must pay the price for the goods specified on our website at the time you place the order. Payments are to be made by Credit Card or Direct Deposit. All prices are in New Zealand dollars and include GST (being tax levied in accordance with the Goods and Services Tax Act 1985 and includes tax levied in substitution for such tax).  Direct Deposit is available to NZ customers only.

The website may show the Australian Dollar amount of a purchase, this is an indication only.  When the transaction is converted on your credit card it will be done so using the Banks exchange rate and any applicable bank fees.  

DISCOUNTS

Discounts offered are a percentage off the original priced cards.  Only one discount can be used per order, either cards are automatically discounted or the customer is required to enter a discount code in the checkout page to redeem their discount.  Discount codes cannot be applied to already discounted cards.  Discounts do not apply to freight.  We do not provide a refund if a discount code has been forgotten.

CARD Delivery

PhotoMaxing prints orders on Tuesday each week (including orders received up until 11am Tuesday NZ time), cards are then checked and dispatched each Wednesday.  Both CourierPost (NZ) and Fedex (Australia) usually take between 1-2 business days for delivery, rural delivery can take slightly longer. Orders to the rest of the World are sent using Airmail.  Dispatch can vary due to public holidays and/or printing delays. 

As PhotoMaxing has no control over the process once cards have been dispatched, we cannot accept responsibility for delays caused by Courier Post, Fedex, NZ Post or other third parties.

Uploaded Images

You may submit photographic images to www.photomaxing.co.nz without limitation. We will provide 7 days free storage from the date of upload. Your photos will be deleted after 7 days without notification. Under these Terms and Conditions, you agree that you will NOT submit any of the following material:

  1. Any threatening, defamatory, abusive, obscene, pornographic, inappropriate or profane material.
  2. Any material that could infringe the rights of privacy, publicity, copyrights or other intellectual property rights without the permission of the owner of these rights.

www.photomaxing.co.nz does not review or comment on the content of uploaded images provided by our users, however, we reserve the right to delete images pertaining to clauses a) and b) above.

Copyright notice

Unauthorised uploading of copyrighted images is illegal. If it appears that an image is copyrighted, you will be required by law to verify that you own the rights to or have received permission to use the image.

intellectual property rights

You retain all intellectual property rights (including copyright) to the images that you have uploaded to our website. However, you authorise us to transmit, print & delete any of your images to enable us to provide PhotoMaxings services. PhotoMaxing will not sell, rent or trade the images you upload to our website.

photomaxing intellectual property

All intellectual property on this website, including without limit, the text, graphics and copyright works is owned by PhotoMaxing. We are the exclusive owner of the design and layout of this website.

About your account

Your account with www.photomaxing.co.nz is available for your personal, non-commercial use.

We will only need to access your account for the following reasons:
- If you forget your password, we can send you a reminder email

- To maintain our service to you and develop new and useful features

Cancelling Your Account

If you violate any of these Terms, your permission to use www.photomaxing.co.nz will terminate automatically.

Third-party software

We may make third party software available to you. To access such third party software, you must first agree to the third party software provider's terms and conditions. www.photomaxing.co.nz is not involved in any such arrangement between you and a third party software provider and disclaims any liability, and provides no warranties relating to such software.

This means that we do not guarantee that any third party software you access will be free of contamination. You acknowledge sole responsibility for and assume all risk arising from your download and use of any such software.

Privacy Policy

When you create an account with PhotoMaxing you need to provide some personal information, such as your name, email address, and mailing address. PhotoMaxing uses your email address to provide you with promotional material so you can be kept up to date with new products and website enhancements. If you choose not to receive this information you may not receive special offers that could be of value to you. PhotoMaxing will not sell, rent or trade the personal information you provide online.

Warranty Disclaimer

www.photomaxing.co.nz makes no warranty that the service will meet your requirements, that the service will be free or uninterrupted, timely, secure, or error free, that the results that may be obtained from the use of the service will be accurate or reliable, that the quality of any purchased service, information or other material obtained by you through the service will meet your expectations, or that the software will work error free or be correct or repaired.

Refunds and Reprints

Refunds and reprints will be given at the discretion of the Company Management.

Disputes Policy

www.photomaxing.co.nz is proud of the product we are able to provide and hold a high commitment to quality. If you are not happy with the product you have received from us please email info@photomaxing.co.nz quoting your order number and the nature of your concern. We will contact you within 24 hours of receiving your email.
